California lawmakers Senator Aisha Wahab and Rebecca Bauer-Kahan have aligned themselves with first lady Melania Trump in support of the federal TAKE IT DOWN Act, which aims to ban non-consensual deepfake pornography and require tech companies to remove such content off their platforms.
The Democrats told POLITICO in exclusive interviews that they welcome the first lady’s push on the Hill this week. “This is where we as society and a country can come together and say ‘We won’t stand for this,’” Wahab said.
Last year, Wahab authored legislation signed by Governor Gavin Newsom, including similar rules allowing people to ask that deepfakes of them be taken down.

“Protecting children from malicious attacks online is something First Lady Melania Trump cares very deeply about, and there is bipartisan support for legislation like the Take It Down Act,” Nick Clemens, the first lady’s communications chief, said.
President Donald Trump did not attend her meeting but posted a Fox News clip of her speech on Truth Social. “Watching our first lady now,” Trump wrote, adding, “Good job!”

Despite the contentious time between political parties, Bauer-Kahan has surprisingly received support from Trump enthusiasts on this issue.
“I often say tech policy is best done when consistent across the country, but that’s been hard the last few years,” the San Francisco politician said.
Bauer-Kahan said that lawmakers should ramp up the pressure on Big Tech to focus their efforts and resources on eradicating harmful and explicit deepfakes.
However, she also noted that while AI methods to identify and remove illegal explicit deepfakes have gotten better, “getting these companies to take ownership over this issue” is more challenging.
Melania also addressed this: “In an era where digital interaction are integral to daily life, it is imperative that we safeguard children from mean-spirited and hurtful online behavior.”
