Additionally, they mentioned a prior BMI license from November 2022 that supposedly allowed Trump to use the song. However, the Hayes estate countered that this license was terminated in June 2024 at their request.

Judge Thrash decided not to dismiss the case. He stated that the estate had “adequately alleged ownership of the work.” He also said they “sufficiently alleged that Mr. Trump personally was involved in the alleged copyright infringement.”
